Terms of Use (EULA)
These terms cover your use of Trackly. Please read the sections on what Trackly is not, how subscriptions renew, and what happens to your data if you lose or delete the app.
Version 1.0 · Last updated 26 October 2026
1. Who these terms are with
Trackly is published by Federica Mariani, an individual established in Italy, with an address at Via Rio de Janeiro 30, Torino, Italy. In these terms, “we”, “us” and “our” mean Federica Mariani. “You” means the person using the app or this website.
By installing or using the app, you agree to these terms. If you do not agree, do not use the app. Write to [email protected] with any question about them.
The store that sold you the app — Apple or Google — is not a party to these terms and does not provide the app. The store’s own terms also apply to your use of the app and to purchases.
2. Age and eligibility
You must be at least 13 years old to use Trackly. If you are under 18, a parent or guardian must review and accept these terms for you. Smart capture is intended only for users aged 18 or over, because the classification provider does not direct its service to children; if you are under 18, use manual logging.
You must be old enough to enter into a contract where you live, or have a parent or guardian accept these terms for you. You are responsible for keeping your device and store account secure.
3. What Trackly is, and what it is not
Trackly is a personal tool for logging everyday spending and seeing what remains of a monthly limit you set yourself. To be plain about the boundaries:
- It is not financial, tax, investment or accounting advice. Nothing in the app or on this site is a recommendation about your money.
- It does not connect to your bank. Every figure comes from entries you make yourself, and the month’s remaining amount is calculated from those entries and your own limit. It is not a bank balance and not a forecast of what you owe.
- It is not a system of record. Do not rely on it as the only copy of anything you cannot afford to lose — see section 9.
- Classification can be wrong. Smart capture suggests a category and cadence. You see the suggestion before saving and can change it. The review step is yours to use.
4. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Trackly on devices you own or control, as permitted by the store terms. You may not sell, rent, sublicense or redistribute the app, or attempt to extract its source code, except where the law says you may.
You may not use the app unlawfully, infringe the rights of others, or attempt to disrupt the app or the classification service. You may not use Smart capture through automated scripts, bulk requests, resale or any other use that is not a normal personal expense entry.
5. Apple, Google and the store terms
On iOS, the app is distributed through the App Store. Apple’s Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these terms. Where that agreement and these terms conflict about the app itself, the stricter of the two applies to the extent the law allows.
On Android, the app is distributed through Google Play. Google Play’s Terms of Service also apply. The store that sold you the app handles the payment, the receipt and the refund process for that purchase.
6. Trackly Pro, free trial, subscription and renewal
Manual expense logging is free. Trackly Pro adds Smart capture — typed and spoken — and is sold as an auto-renewing subscription through the store. The available plans are monthly and yearly.
- Price and period: the price, the billing period and whether a free trial applies are shown in the app, in your own currency and region, before you confirm. The price shown on the purchase screen at that moment is the price that applies.
- Payment: the store charges your Apple Account or Google Play account when you confirm the purchase. We never see or store your card details.
- Automatic renewal: the subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period on iOS, or before the renewal date under Google Play’s rules. Apple may charge up to 24 hours before the renewal date. The store confirms the exact timing in your account.
- Free trial: if a trial is offered, the app shows its length and the price that follows before you confirm. If you do not cancel before the trial ends, the paid subscription starts and the price shown is charged. Any unused part of a trial ends when you buy a subscription, where the store applies that rule. There is no trial unless the purchase screen shows one.
- Cancellation: you manage and cancel in your Apple Account settings or Google Play subscriptions, not in the app. Cancelling stops the next renewal; it does not shorten the period you have already paid for.
- Price changes: if we change the price, the change applies from your next renewal rather than retroactively, and the store notifies you in the way your account settings require so you can cancel first if you disagree.
- Restore: you can restore a previous purchase from the app or the store, subject to the store’s rules.
7. Refunds and your right of withdrawal
Your purchase is with the store, not with us, so refunds are granted by the store and requested through its own process — we cannot issue or refuse one. On iOS, use Apple’s report-a-problem process; on Android, use Google Play’s refund process.
If your purchase of digital content or a digital service carries a statutory right of withdrawal under Italian or EU consumer law, it is exercised through that same process, at the point of sale. Where the law allows the right to end when performance begins, the store asks for your express consent and acknowledgement before immediate access. Nothing in these terms limits any right that consumer law gives you and that cannot be waived by agreement.
8. What you are responsible for
- Using the app lawfully, and keeping your device and store account secure.
- The accuracy of what you enter. Classification produces suggestions you review before saving, and the review step is yours to use.
- Not entering other people’s sensitive data, or data you do not have the right to use, into Smart capture or support email.
- Not abusing the service — no automated or bulk use of the classification feature, no attempts to disrupt it, and no attempts to reach data that is not yours.
9. Your data and local storage
Your ledger is stored on your device and handled as described in the Privacy Policy, which forms part of these terms. You keep whatever rights you have in the content you enter; we claim none over it, because we never receive it.
Trackly keeps your ledger on your device only. That has a consequence you should know before you rely on it:
- Deleting the app deletes your ledger. So does losing or erasing the device without a backup that includes it.
- Your data does not move automatically to a new phone or a reinstall, and we hold no copy that could restore it.
- Export and restore are not yet implemented in the shipped app. Until they are, treat the app as a working record rather than your only copy of anything important.
- A device backup made by Apple or Google may include app data depending on your settings; that backup is controlled by the provider, not by us.
10. Availability, changes and updates
We may add, change or remove features, and we may update the app through the store or as an over-the-air update. Some parts of the app depend on services outside our control — Apple’s or Google’s speech recognition, store billing, Cloudflare and the classification service behind Smart capture — and may be unavailable or behave differently at times. We do not promise uninterrupted or error-free operation.
This site describes the app as it stands at 26 October 2026. Feature availability and pricing shown anywhere else may lag behind the app you have installed, and the in-app purchase screen is what governs a purchase. If we stop offering Pro, we will not charge you for a period you have not received, and the store’s refund rules apply.
11. Limits of our liability
The app is provided “as is”. To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profit or goodwill — including loss of the ledger held on your device, as described in section 9 — arising from your use of the app. To the extent permitted by law, our total liability for direct loss arising from these terms is limited to the amount you paid for Trackly Pro in the 12 months before the event.
This does not apply where it cannot. Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence, or for any other liability that Italian or EU law does not allow to be excluded — including the mandatory protections the Italian Consumer Code gives you as a consumer. The cap above does not apply to those liabilities.
12. Termination
You may stop using the app at any time. We may suspend or terminate your access if you materially breach these terms, if you use the app unlawfully, or if your use could harm other users or the service. Where the breach can be cured, we will give you notice and a reasonable chance to cure it. On termination, your right to use the app ends, but the sections that by their nature survive — intellectual property, disclaimers, liability, governing law and this section — continue to apply.
13. Governing law and disputes
These terms are governed by the law of Italy. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the court of your own place of residence or domicile, as the Italian Consumer Code provides.
Before anything formal, please write to [email protected] — most problems are ours to fix quickly. The European Online Dispute Resolution platform was discontinued on 20 July 2025, so these terms do not link to it. This does not affect your right to go to court or to use a consumer dispute body available where you live.
14. Changes to these terms
We may update these terms when the app or the law changes; the version and date at the top of this page move when we do. A material change is shown in the app and, where required, you are asked to accept the new version before continuing. If you do not agree to a change, stop using the app; if you have a paid subscription, the store’s terms and mandatory consumer law apply.
15. General
If any provision of these terms is held invalid or unenforceable, the rest remains in force and the invalid provision is replaced by the closest lawful provision. These terms, together with the Privacy Policy, are the entire agreement between you and us about the app. A failure to enforce a provision is not a waiver. You may not assign your rights under these terms; we may assign ours to a successor of the app, subject to your rights. The English version is the authoritative version. We will publish an Italian translation; until then, if you are an Italian consumer and need the Italian text, write to us.
